Terms of Service

Article 1 (Scope of Application)
- These Terms of Service (hereinafter "Terms") set forth the conditions for using Hirameki (hereinafter "the Service"). The Service is operated by an individual operator (hereinafter "the Operator").
- Users shall use the Service upon agreeing to these Terms.
Article 2 (Definitions)
The following terms used in these Terms shall have the meanings set forth below.
- "User" refers to an individual or entity that registers for and uses the Service.
- "Content" refers to mind maps, text, images, and any other data that Users create, post, or share on the Service.
- "Account" refers to the authentication credentials created by a User to use the Service.
Article 3 (Account Registration)
- Users shall register an account by providing accurate and up-to-date information.
- Users shall properly manage all information related to their account at their own responsibility and shall not allow third parties to use it.
- Minors must obtain the consent of their legal guardian before using the Service.
- The Operator may refuse registration in any of the following cases:
- The registration information contains false, erroneous, or incomplete information
- The applicant has previously violated these Terms
- The Operator otherwise deems the registration inappropriate
- The Operator shall not be liable for any damages arising in connection with an account, except in cases of willful misconduct or gross negligence by the Operator.
Article 4 (Prohibited Acts)
Users shall not engage in any of the following acts when using the Service:
- Acts that violate laws, regulations, or public order and morals
- Acts related to criminal activity
- Acts that destroy or interfere with the functionality of the Operator's servers or networks
- Acts that may interfere with the operation of the Service
- Collecting or accumulating personal information of other Users
- Unauthorized access or attempts thereof
- Impersonating other Users or third parties
- Acts that infringe upon the intellectual property rights, portrait rights, privacy, reputation, or other rights of the Operator or third parties
- Posting or transmitting Content containing excessively violent expressions, explicitly sexual expressions, discriminatory expressions, expressions that encourage suicide or self-harm, expressions that encourage inappropriate use of drugs, or other antisocial content
- Acts intended for harassment, defamation, or intimidation
- Acts for commercial purposes (except those permitted by the Operator)
- Providing benefits directly or indirectly to antisocial forces
- Any other acts deemed inappropriate by the Operator
Article 5 (Use of the Service)
- The Service is currently provided free of charge. The Operator may change the Service at any time for any reason.
- Users shall use the Service at their own responsibility and shall be solely responsible for all actions taken in connection with the Service and their consequences.
Article 6 (Usage Restrictions and Account Suspension)
- The Operator may, without prior notice, restrict all or part of a User's use of the Service, or suspend or delete a User's account, in any of the following cases:
- The User has violated any provision of these Terms
- False information is found in the registration details
- The User fails to respond to communications from the Operator within a reasonable period
- There has been no use of the Service for a certain period since the last access
- The Operator otherwise deems the User's use of the Service inappropriate
- The Operator shall not be liable for any damages incurred by Users due to measures taken under this Article, except in cases of willful misconduct or gross negligence.
Article 7 (Handling of Content)
- Copyright in Content created by Users belongs to the respective Users.
- Users grant the Operator a license to use their Content to the extent necessary for providing and operating the Service.
- The management and preservation of Content is the sole responsibility of Users. The Operator shall not be liable for any damages arising in connection with Content, except in cases of willful misconduct or gross negligence.
Article 8 (Intellectual Property Rights)
Intellectual property rights related to the Service (excluding User Content) belong to the Operator or their rightful owners.
Article 9 (Changes, Suspension, and Termination of the Service)
- The Operator may suspend the provision of all or part of the Service without prior notice to Users in any of the following cases:
- Maintenance, inspection, or updating of servers, communication lines, or other equipment
- Difficulty in providing the Service due to force majeure such as earthquakes, lightning, fire, or power outages
- Difficulty in providing the Service due to computer or communication line failures
- The Operator otherwise determines that provision of the Service is difficult
- The Operator may change or terminate all or part of the Service at any time for any reason.
- The Operator does not guarantee any level of service.
- The Operator shall not be liable for any damages incurred by Users due to measures taken under this Article, except in cases of willful misconduct or gross negligence.
Article 10 (Account Deletion and Data Removal)
- Users may withdraw from the Service at any time through the prescribed procedures.
- The handling of data after withdrawal shall be at the Operator's discretion, and data recovery is not supported.
Article 11 (Disclaimer)
- The Service is provided as is, and the Operator makes no warranties of any kind, express or implied, regarding the Service.
- Except in cases of willful misconduct or gross negligence, the Operator shall not be liable for any damages arising out of or in connection with the Service to Users or any third parties, regardless of the type, cause, or basis of liability.
- Notwithstanding the preceding paragraph, where the Operator is liable for damages, such liability shall be limited to the total amount the User has paid for the Service during the preceding twelve (12) months.
- Any disputes arising between Users or with third parties shall be resolved between the parties involved, and the Operator shall not be involved.
Article 12 (Indemnification)
Users shall indemnify the Operator for any damages incurred by the Operator in connection with the User's use of the Service.
Article 13 (Handling of Personal Information)
Users' personal information shall be handled appropriately in accordance with the Privacy Policy separately established by the Operator.
Article 14 (Changes to the Terms)
- The Operator may change these Terms as necessary.
- Revised Terms shall take effect upon being posted on the Service, and continued use of the Service after posting shall be deemed acceptance of the changes.
Article 15 (Severability)
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes relating to these Terms.
